1. Who you are contracting with

The Atlanta Folio (the "Service") is operated by Brandon Tucker ("we," "us," "our"), a sole proprietor based in Georgia, USA. By accessing or using the Service you agree to these Terms.

2. The Service

The Atlanta Folio is a curated digital field guide to date nights in Atlanta and surrounding cities. A one-time $24 lifetime purchase unlocks $$$ entries and seasonal collections for as long as the archive is published.

3. Eligibility & accounts

You must be of legal age in your jurisdiction to create an account. You are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not: use it for unlawful purposes; commit fraud or send spam; infringe intellectual property; introduce malware; probe, scan, or scrape the Service; or attempt to circumvent its technical or commercial limits.

5. Intellectual property

The Service, its content, design, and software are owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access the Service for your personal, non-commercial use. You may not resell, redistribute, or reverse-engineer any part of it.

6. Service level

We do our best to keep the Service available and accurate, but it is provided on an "as is" basis. We do not warrant uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Payment & subscription terms

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellations, and refunds are governed by Paddle's Checkout Buyer Terms. The $24 lifetime purchase is a one-time charge — there is no recurring subscription.

8. Suspension & termination

We may suspend or terminate access for material breach of these Terms, non-payment (where applicable), security or fraud risk, or repeated policy violations. On termination, your right to access the Service ends. Local consumer rights (including refund rights through Paddle) remain unaffected.

9. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the amount you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where prohibited by law.

10. Changes

We may update these Terms from time to time. Material changes will be highlighted in the app or via email. Continued use after a change constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Fulton County, Georgia.
